Terms of Service (Merchants)

Plain summary: 7-day free trial, then ₦5,000/month. Ngozi answers your customers on your own WhatsApp number. Money from customers goes straight to you — Ngozi never holds funds and never confirms a payment; only you do. You stay in control and can pause her anytime. If a subscription is not paid, the service pauses automatically. AI can make mistakes — review what matters.

1. The service

Ngozi is an AI customer-care assistant that operates on the Merchant's existing WhatsApp number. She replies to customer enquiries using information the Merchant provides, captures orders and bookings, forwards payment-receipt images for the Merchant's confirmation, and sends a daily business report. A web dashboard is provided for management.

3. Fair use

"Unlimited conversations" means normal business use by one business on one WhatsApp number. We may reasonably throttle or discuss alternative pricing for exceptional usage that threatens service quality for others (for example, automated bulk traffic, resale, or sustained volumes far beyond typical small-business levels). We will always contact you before applying any restriction.

4. WhatsApp connection — important disclosure

Please read this carefully. Ngozi connects to your number using WhatsApp's linked-device mechanism. This is not an official Meta/WhatsApp business partnership or API integration. WhatsApp's systems may occasionally disconnect a linked device, and in rare cases WhatsApp may restrict numbers that it believes breach its terms. We reduce this risk by design (Ngozi only replies to people who message your business first, never sends bulk or marketing blasts, and behaves conservatively), we monitor your connection continuously, and we alert you immediately with a one-tap reconnect if the link drops. By using the service you accept this risk. An official WhatsApp Business Platform option (dedicated line) is planned for merchants who require it.

7. AI limitations

Ngozi uses artificial intelligence. She is designed to escalate to you when unsure, is prohibited from inventing prices or delivery fees, and always identifies as an AI assistant when asked. Nevertheless, AI can occasionally misunderstand or answer imperfectly. The service is provided "as is"; you should review order summaries and escalations. Bamaja's total liability under these terms is limited to the subscription fees you paid in the three months before the claim. We are not liable for indirect losses, lost profits, or actions of WhatsApp/Meta, network operators, or payment providers.

8. Data

Data handling is described in the Privacy Policy and the Data Processing Agreement, which form part of these terms. You are the controller of your customers' data; we process it on your instructions.

9. Suspension and termination

We may suspend or terminate accounts for non-payment (automatic pause), breach of these terms, unlawful use, or risk to the platform, customers, or other merchants — with notice where practicable. You may close your account at any time from the dashboard or by contacting support; data is then deleted per the Privacy Policy.

10. Changes

We may update these terms with reasonable notice to merchants (dashboard notice or WhatsApp message). Continued use after the effective date means acceptance.

11. Law and disputes

These terms are governed by the laws of the Federal Republic of Nigeria. Disputes will first be addressed in good faith through support; unresolved disputes are subject to the courts of Lagos State.
